Re: legal reason

No, sounds like they're spinning you one, or they don't understand the law themselves. Ask them for more details, and I bet they won't be able to.

There has been some other discussion about collecting licences, but the conclusion was that they are not required or enforced for small quantities. I think that was for QLD, but I have not heard of any requirement in NSW.

However, if they don't want you collecting their oil it's probably best to move on. Maybe come back in 6 months and see if they are more agreeable then.

Re: legal reason

Chewy,
Most likely they have been contacted by another oil collector (licensed) who has frightened your supplier into signing a contract with them and to do it he has threatened him with being reported to the Dept of Environment for using a non-licensed collector.

Talk to the D of E and get something in writing about small volume collectors and their responsibilities in complying wth the regulations (and/or exemptions which apply)

Then talk to him and let him know about the legal requirements, supported by the letter form D of E.

Perhaps he will give the licensed collector the shove and re-continue to supply you.

Regards,
Tony

Re: legal reason

You Need a license to carry, pick up more than more than 200 litres a go. And your probably not gonna do that very often in just picking up 25 litre tins. its more about traffic OH&S than anything else, and writing a report to EPA about where you (the trucky) are dumpingt it,, stuff for tanker trucks and the like. If that is the spin they're (restaurant) telling you then they should have installed on their site a 1000 litre heater tank with a suck truck valve that they put all their oil in. Which is a hassle for you to take anyway unless you've got a suck pump. If they're leaving the stuff (WVO) in 20 litre tins they're full of SH#T telling you legal bumf. as they have more legal requirements than you (the waste man).

Re: legal reason

The NSW EPA were certainly putting pressure on Shopkeepers in the Central West last year. Read about it in THIS THREAD. While the Business Owner wasn't prosecuted in the end, there was certainly enough "Grey Areas" about definitions of waste, treating and transporting that he is now steering clear of privateers and only allowing his WVO to be collected by a fully acredited contractor.
